FIRST: Background.
The MA´U HENUA INDIGENOUS COMMUNITY owns or has a license for the use of the software, trademark, and other copyright and intellectual property rights of the platform named “RAPANUINATIONALPARK”.
RAPANUINATIONALPARK is a computing platform, which includes the Website, as well as any subdomain of it, and any other Website through which the services of RAPANUINATIONALPARK are made available for the purchase and sale of tickets and other products associated with various events, such as artistic, cultural and/or sporting shows, distinguished by its design, speed, and security in the provision of such service. Hereinafter the Website will be referred to as the “RAPANUINATIONALPARK Platform”, either with its current name or any other designation it may bear in the future.
RAPANUINATIONALPARK is the exclusive property of the MA´U HENUA INDIGENOUS COMMUNITY, located at Mataveri s/n, Hanga Roa commune, Easter Island; Valparaíso Region, and is legally represented by its president, Mr. GABRIEL ARMANDO TUKI TUKI.
This instrument regulates the use of the website www.rapanuinationalpark.com and all subdomains of that page and also the scope of the services provided by the Platform to the Buyer or User.
SECOND: Acceptance of the Terms and Conditions.
The Buyer or User, in order to acquire entrance tickets to RAPA NUI NATIONAL PARK, must accept in advance and in full the Terms and Conditions established on our Website.
In light of the above, we recommend that our Users frequently review the Terms and Conditions and, in any case, always before making a purchase of tickets, so that, in case they do not agree with them, they desist from using our service.
THIRD: Conditions of Use of the RAPANUINATIONALPARK Platform.
To use our RAPANUINATIONALPARK Platform, first, the User of this platform must provide data. The User guarantees and declares at this time the truthfulness, accuracy, and validity of their data. The User will be liable for any damages that arise from the breach of the previously referred obligations. The User is solely responsible for the truthfulness of the information they provide at the time of registering their purchase.
The User must strictly comply with the aforementioned Terms and Conditions.
RAPANUINATIONALPARK may require the User additional information for a specific event in which they wish to participate. In these cases, the information will be requested at the time of purchasing the ticket online. The information provided by the User will be stored for statistical purposes and to offer security in the purchase transaction. RAPANUINATIONALPARK is responsible for ensuring that this information is received to complement the request required by the User and undertakes to keep it protected. RAPANUINATIONALPARK uses the highest technology to safeguard personal information of Users, however, we inform you that, to date, there is no mechanism that is completely immune to cyber-attacks from third parties looking to intercept or obtain information illegally or without authorization.
FOURTH: Conditions of Sale.
To acquire tickets, you must enter www.rapanuinationalpark.com, where you will find the prices for entrance tickets to the park.
RAPANUINATIONALPARK will sell tickets to Users through its Website and only at certain events will it sell them physically at another designated location.
The final price of each ticket through RAPANUINATIONALPARK will consist of the following concepts:
Service charge, which is charged for each of the purchased entrance tickets and corresponds to the sales service provided by the VIRTUALPOS platform.
Charge for the value of the entrance ticket, total amount received by the administrator of the Rapa Nui National Park.
RAPANUINATIONALPARK will not charge interest in the sale of tickets, regardless of the payment method. Should these concepts exist, they will be exclusively determined by the payment method selected by the User.
The User must review the details of their purchase before confirming it and, subsequently, only if they agree with all the provided information, finalize the ticket purchase.
RAPANUINATIONALPARK, in accordance with article 3 letter b) of Law No.19.496 on Protection of Consumer Rights, expressly informs that no refunds or returns will be made at the sole will of the buyer once the purchase process has been completed by the buyer, who acquires one or more entrance tickets, that is, there is no right to withdraw, being their only authority to request a change of date, of up to one year, or the name of the holder, to use the purchased ticket.
At RAPANUINATIONALPARK, you can purchase your entrance ticket through VirtualPOS debit, VirtualPOS credit, prepaid (MACH, Chek), electronic transfer, or other enabled and authorized means on the website www.rapanuinationalpark.com
The transaction will be subject to the verification of the User's data by the banking entity or other, as appropriate.
Each person has a limit of purchasing 6 entrance tickets, having to carry out another process if the required quantity is greater than the limit.
We reiterate that before confirming the purchase through the RAPANUINATIONALPARK Platform, the User must meticulously review that their personal data is correct, that they are up to date, and that the purchase data exactly matches their interests. We also reiterate that no changes, returns or refunds are made at the sole will of the User, as established in clause seven on the Ticket Return Policy.
FIFTH: About the Delivery of Tickets.
Once the purchase of the ticket(s) has been confirmed by the User, they may download their corresponding E-Ticket. Each E-ticket contains a "QR" code or another unique code, which will be validated at the entrance to the park sites.
The User may print their E-Ticket or present it from their cell phone, along with their identification document.
An "entrance" or "ticket" or "E-ticket" shall be understood as that receipt which RAPANUINATIONALPARK provides and which the Buyer receives in their email or another authorized application, which contains a "QR" code granting them the right to enter the RAPA NUI NATIONAL PARK.
The ticket is personal and non-transferable, so it must be kept with due care, avoiding any possible damage that could prevent its validation when entering the sites. The User will be responsible in case of loss, theft, or deterioration of the tickets.
The E-Ticket can be printed as many times as necessary from the website www.rapanuinationalpark.com, without prejudice to the fact that the code used to enter the event is unique and is validated and “burned” prior to entering the sites.
On occasions when tickets are printed, it is advised that they not be exposed directly to sunlight or extreme environmental conditions, as this may affect the ticket and thus make its use impossible. Additionally, it is recommended not to provide heat or cold to printed tickets to avoid altering the security elements contained within them. Such circumstances could alter the tickets and make them unusable.
SIXTH: Ticket Features.
Tickets can be purchased through the Website www.rapanuinationalpark.com, or through the authorized physical points of sale, as applicable. These tickets are valid for 10 days from the user's arrival in Rapa Nui and cannot be used for other events, no matter how similar they are.
Tickets are personal and non-transferable, so the User becomes responsible for their ticket once purchased. E-Tickets or tickets are non-refundable, according to the policies established in these terms and conditions.
SEVENTH: Ticket Return Policy.
RAPANUINATIONALPARK, in accordance with the provisions of article 3 letter b) of Law No.19.496 on Protection of Consumer Rights, expressly informs that no changes, refunds, or returns will be made at the sole will of the buyer once the purchasing process has been completed by the buyer who acquires one or more entrance tickets, that is, there is no right of withdrawal.
If the user purchased one or more tickets through our website www.rapanuinationalpark.com and for some reason cannot travel to Rapa Nui on the indicated date and consequently cannot use their ticket, RAPANUINATIONALPARK WILL NOT make refunds or money returns, but will allow modification of the ticket data and its use within a maximum period of one year.
EIGHTH: Entry to Venues.
Users must present their tickets at every access control to the sites of the Rapa Nui National Park, or whenever requested by the staff of the MA´U HENUA INDIGENOUS COMMUNITY, and must also be accompanied by a guide and respect the park rules at all times.
NINTH: Prohibition
Entry of cameras, recording devices, or other similar devices (except for cell phones) may be prohibited if the staff working in the park verifies that recordings or activities are being conducted without authorization from the administrator of Rapa Nui National Park, with the aim of protecting the rights of the MA´U HENUA INDIGENOUS COMMUNITY.
Likewise, users may be screened in order to comply with the purpose established in the preceding paragraph and, likewise, for security reasons. If, after the screening, it is found that an attendee carries knives, alcohol, or other similar items that affect the security of the event, access will be denied.
TENTH: Data Protection and Privacy Policy.
The use of the personal data provided by the User must be previously consented to by them and will have the following purposes: (i) Validate ticket purchase orders; (ii) Establish records and statistics.
The transfer of information to third parties without prior authorization from the User is prohibited, that is, to legal or natural persons other than the MA´U HENUA INDIGENOUS COMMUNITY, its RAPANUINATIONALPARK platform, and its affiliates.
RAPANUINATIONALPARK uses the highest technology to safeguard Users' personal information; however, we inform you that, to date, there is no mechanism that is completely immune to cyber-attacks from third parties seeking to illegally intercept or obtain information without authorization.
RAPANUINATIONALPARK does not store information related to the User's payment methods, nor does it carry out a validation process of the information registered by the User, so it is the User's responsibility that this information is current and truthful. In the event of issues directly related to the payment method, the User should contact the corresponding banking entity, with RAPANUINATIONALPARK being able to provide any assistance the User needs to resolve the issue with that entity.
The Client authorizes RAPANUINATIONALPARK to carry out promotional and/or advertising communications for products associated with various types of events, such as artistic, cultural, and/or sporting shows, with which RAPANUINATIONALPARK is related. If the Client does not wish to receive these communications, they may request their cessation by sending an email to contacto@violet-emu-522130.hostingersite.com, expressing their disapproval.
When Users use our websites (including websites or apps for mobile devices), both we and various third-party organizations may collect information using 'cookies' and other technologies (to simplify, we will refer to all these technologies as 'cookies'). By visiting our sites, creating an account, or purchasing tickets, the User agrees that both we and various third-party organizations may use cookies in accordance with their cookie settings. ELEVENTH: Responsibility.
The MA´U HENUA INDIGENOUS COMMUNITY is responsible for the website www.rapanuinationalpark.com and for the purchase of tickets through it.
RAPANUINATIONALPARK uses the highest technology to safeguard its Platform, which does not absolutely prevent third parties, commonly referred to as “hackers”, from infecting or damaging the Website.
The MA´U HENUA INDIGENOUS COMMUNITY is the one that executes the validation process of the entrance tickets in all the authorized sites of the Rapa Nui National Park.
TWELFTH: Inactivity of the RAPANUINATIONALPARK Platform.
The RAPANUINATIONALPARK Platform may be inactive in the following cases:
Scheduled maintenance: which consists of the planned interruption of service to carry out maintenance on it.
Force majeure: for the purposes of this document, circumstances that could not have been foreseen, or that, if foreseen, were unavoidable, and that prevent the affected party from fulfilling their respective obligations under the Terms and Conditions will be considered as force majeure. The above, in accordance with article 45 of the Civil Code.
Meeting the requirements of article 45 of the Civil Code, the following facts, among others, may be invoked as causes of Force Majeure: (i) Outbreak of war, declared or not, military invasion or armed hostilities; (ii) Outbreak of riots, insurrection, turmoil or civil war; (iii) Acts of piracy; (iv) Earthquake of a magnitude greater than 7.0 on the Richter scale, volcanic eruption, hurricane, flooding, or other natural disasters; (v) Accidents directly resulting from a Force Majeure event; (vi) Outbreak of a serious disease or epidemic, quarantines, or other public health emergencies; (vii) Strikes, stoppages, or any type of labor conflict, legal or illegal, that affects the functioning of the system; (viii) Viruses; (ix) Connectivity errors of the network, or any other cause of unavailability of the service that is beyond the reach or reasonable control of the MA´U HENUA INDIGENOUS COMMUNITY.
